How about Data Protection?

Company Check Ltd is registered under The Data Protection Act, no. Z2990209. 

Although Company and Director data is not subject to the Data Protection Act, as a data driven business, we take Data Protection seriously and act in accordance with the GDPR legislation implemented May 2018, and with the Information Commissioner's guidelines and Data Protection Act (DPA). 

What about section 10 of the DPA?

The DPA states that if an individual believes that a data controller is processing personal data in a way that causes, or is likely to cause, substantial unwarranted damage or substantial, unwarranted distress to them or to another, Section 10 of the Act provides that the individual has the right to send a notice to the data controller requiring him, within a reasonable time, to stop the processing (the “data subject notice”). Company Check however, processes personal information in keeping with the statutory framework publicly available, therefore Section 34 of the DPA applies in this case as the information Company Check Ltd provides is publicly available data from Companies House. Section 34 of the Act provides that when data consists of information which the data controller is obliged by, or under, any enactment to make available to the public, personal data are exempt from:

• the subject information provisions


• the Fourth Data Protection Principle (accuracy)


• the non-disclosure provisions

The application of Section 34 in this case would therefore exempt the following non-disclosure provisions:

• an individual’s right to object to processing that is likely to cause or is causing damage or distress; and


• an individual’s right in certain circumstances to have inaccurate personal information rectified, blocked, erased or destroyed
